1. What Is This Document About?

This document sets out the shared rules for using Edebiyatla (www.edebiyatla.com and related digital services). It also explains how we handle your personal data. Whether you are a reader, poet, writer or simply a visitor, everyone using the site is covered by these terms.

We process your personal data in accordance with the Constitution, the international agreements to which Türkiye is a party and, in particular, Personal Data Protection Law No. 6698 ("KVKK"). We respect privacy, freedom of communication and freedom of artistic expression, and we take up-to-date technical and administrative measures to protect your data.

2. Responsibilities

Management: Oversees the application of these terms and makes final decisions on violations.
Content & Complaints Team: Reviews user reports, infringement claims and our suppliers' compliance with the rules.
Technical Team: Responsible for infrastructure continuity, secure log retention and the technical measures required by KVKK.

3. Using the Site

3.1 Acceptance. By accessing the site or registering, you confirm that you have read and accepted these terms. If you do not accept them, please do not use the site.

3.2 Who is a "user"? Any natural or legal person accessing the site, whether registered or not.

3.3 Changes. We may update these terms from time to time. We announce material changes on the site and, where necessary, by email. The new version takes effect on publication. Continuing to use the site afterwards means you accept the updated terms.

3.4 Your account.

Your registration details must be accurate and up to date.
You are responsible for protecting your password and account security.
You may not transfer, sell or rent your account or username.
Without documented authority, you may not open an account on behalf of others or ask for their login details.

3.5 Abuse of the system.

Scraping content with bots, crawlers or scrapers without permission, sending excessive requests and exhausting resources is prohibited.
Any attempt to slow down, disrupt or infect the site with malware will result in blocked access and legal action.

4. Your Content

4.1 Responsibility. You bear the legal and criminal responsibility for what you share, such as poems, stories, essays, comments, messages, images and audio. Under Law No. 5651, Edebiyatla is a hosting provider and is not required to review content before publication.

4.2 What may not be shared. The following are prohibited in posts and private messages:

Content that constitutes or incites a crime
Insults, profanity, defamation, threats and harassment
Violence, hate speech and discrimination based on race, language, religion, gender or ethnicity
Pornographic or obscene material
Information violating others' privacy or personal rights
Content causing unfair competition or damaging commercial reputation
Unauthorized advertising, spam and promotional links

4.3 Intervention. We may remove or edit content that breaks the rules without notice, and suspend or close violating accounts.

5. Copyright

5.1 Your work is yours. Economic and moral rights in your original works under Law No. 5846 on Intellectual and Artistic Works ("FSEK") remain with you.

5.2 The permission you give us. To display your content on the site, mobile interfaces, community pages and Edebiyatla's promotional channels, and to reproduce and transmit it digitally, you grant us a license that is:

non-exclusive
royalty-free
worldwide
valid until the content or account is deleted

5.3 Your warranty. You declare and warrant that all content you share consists solely of your own original works; that you will not publish works belonging to others (even with claimed permission); and that your content does not infringe third parties' copyright, intellectual property or privacy rights.

5.4 Infringement reports. Rights holders can write to [email protected] with supporting evidence. Content is removed promptly when a report is found justified.

5.5 Platform materials. Edebiyatla's design, software, database, logo and interface are protected under FSEK and the Industrial Property Law. They may not be copied or reverse-engineered without permission.

6. Limitation of Liability

The service is provided "as is". We do not guarantee that it will be uninterrupted, error-free or fully secure against attacks.
Content on the site is for literary, cultural and informational purposes and is not legal, medical or financial advice.
We are not responsible for the content or privacy practices of linked third-party sites.
To the extent permitted by law, we are not liable for indirect damages arising from your use of, or inability to use, the site.

7. Personal Data (KVKK Information Notice)

7.1 Data we process

Identity and contact: Name, surname, username, email address
Profile and interaction: Biography, profile photo, posts, comments, follows and likes
Technical data: IP address, session logs, browser and device information, cookies

7.2 Purposes and legal grounds (KVKK Art. 5–6)

Establishing and performing the membership agreement
Account creation, authentication and security
Publishing content and interactions
Retaining traffic logs as required by Law No. 5651
Improving the service and statistical analysis (via cookies based on your explicit consent)

7.3 Transfers

We do not sell your data. We share it only with:

Suppliers providing hosting, storage, email and analytics services (as data processors)
Competent public authorities where required by law or official request

Some of these suppliers (e.g. cloud storage and web analytics services) have servers abroad. These transfers are made in line with the safeguards in KVKK Art. 9.

7.4 Retention

We keep your data for as long as your membership continues and for statutory periods. When these periods end, or upon your request, we delete, destroy or anonymize it under KVKK Art. 7.

7.5 Your rights (KVKK Art. 11)

You may apply to us to:

Learn whether your data is processed and, if so, request information
Learn the purpose of processing and whether data is used accordingly
Know the third parties in Türkiye or abroad to whom data is transferred
Request correction of incomplete or inaccurate data
Request deletion or destruction under KVKK Art. 7
Request that corrections and deletions be notified to recipients
Object to a result against you arising solely from automated analysis
Claim compensation for damage caused by unlawful processing

8. Security and Cookies

Data in transit is encrypted with TLS. Passwords are stored using one-way hash algorithms.
Do not share your password. You are responsible for information sent via unencrypted email.
We use cookies to maintain sessions, improve the experience and collect statistics. See our Cookie Policy for details.

9. Governing Law

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction. Your right as a consumer to apply to consumer arbitration committees and consumer courts is reserved. If any provision is held invalid, the others remain unaffected.
